JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 09-07-2018 Heard the learned counsel for the petitioner and State. The petitioner is in custody in connection with Basantpur P.S. Case No. 238 of 2017 for the offence under Sections 279, 272, 273, 308, 353, 307, 427/34 of the Indian Penal Code and Section 30, 37 of the Bihar Prohibition of Excise Act.

The name of the petitioner surfaced on the disclosure of the driver of the Bolero vehicle, from which 209.94 liters liquor was recovered. From the written, report it appears that the vehicle of the police party was targeted by Bolero bearing no. BR29F-8334 in the accident police party sustained injury and as such the case was registered. After accident 209.94 liquor was recovered from the vehicle which dashed the police jeep. Learned counsel submit that other co-accused namely Sonu

Patna High Court Cr.Misc. No.39412 of 2018(2) dt.09-07-2018 2/2 Ansari and and Rajesh Prasad have been granted bail by this court vide Cr. Misc. No. 52968 of 2017 vide Cr. Misc. No. 53368 of 2017 receptively.

Considering the fact that other co-accused have been granted bail and allegation of the petitioner is similar to those co-accused, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II at Siwan in connection with Basantput P.S.
