The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 120B, 323, 504 and 506 of the Indian Penal Code. The prosecution case is that the informant gave one and half lac rupees to the petitioner in the month of March, 2009 on assurance of installing mobile tower on the land of the informant. The money was given on the assurance that the informant will earn rupees six thousand per month on the installation of mobile tower. The petitioner collected the amount from several persons and on 29.12.2015 when the informant asked the petitioner to return the money then he started abusing
Patna High Court Cr.Misc. No.20507 of 2016 (2) dt.12-05-2016 2/2 and assaulting the informant.
It is submitted by learned counsel for the petitioner that there is no proof with regard to the payment. The petitioner is not connected with any mobile company. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Siwan in connection with Maharajganj P.S. Case No. 39 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
