JUSTICE RAMESH KUMAR DATTA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner prays for anticipatory bail in a case registered under Sections 457 and 380 of the Indian Penal Code. Learned counsel for the petitioner submits that the allegation of committing theft of Rs. 85,000/- has been falsely made against the petitioner and the statement regarding such criminal activities in the past is not supported by any chit of paper. It is submitted that there is nothing in the FIR to show that any one had seen the petitioner taking away the said amount and the entire allegation is out and out false and based upon mere suspicion and conjecture.

On a consideration of the facts and circumstances

Patna High Court Cr.Misc. No.33806 of 2014 (2) dt.04-02-2015 2/2 of the case, it is directed that the petitioner, Hanuman Paswan, in the event of his arrest/surrender in the court below within six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Bihpur P.S. Case No. 212 of 2014 to the satisfaction of the ACJM, Naugachia, subject to the conditions laid down under Section 438(2) Cr.P.C. (Ramesh Kumar Datta, J) S.Pandey/- U T
