Petitioner, already in custody, seeks bail in connection with Sahar P.S. Case No.40 of 2017 registered under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the FIR is against unknown, there is no eye-witness to the occurrence and merely on suspicion on the ground that the petitioner had verbal duel previous day with the deceased on the issue of selling toddy, the petitioner has been implicated in this case, except that there is no other material against him and the petitioner has no criminal antecedent.

Having considered the aforesaid facts and circumstances, petitioner Ajay Chaudhary is directed to be

Patna High Court Cr.Misc. No.39104 of 2018(2) dt.05-07-2018 2/2 released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-X, Bhojpur at Ara in connection with Sahar P.S. Case No.40 of 2017.
