The petitioner, who is in custody since 18.11.2019 and is a person of clean antecedent, seeks bail in connection with Gaighat P.S. Case No. 415 of 2019 dated 18.11.2019 instituted for the offences under Sections 395, 397 and 412 of the Indian Penal Code. The FIR has been registered against unknown.

It has been alleged in the FIR that the vehicle of the informant was stopped by approximately nine miscreants and he was divested of his personal belongings. The vehicle was also looted away.

The petitioner appears to have been arrested on suspicion. There does not appear to be any recovery of any incriminating substance from the possession of the

The Apache motorcycle which is stated to have been used by the miscreants does not belong to the petitioner. Considering the aforestated facts, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-15, Muzaffarpur in connection with Gaighat P.S.
