2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 303(2) and 317 of the BNS.

3. The case of the prosecution is that from the possession of this petitioner, stolen bike which is subject matter of Ara, Nawada P.S. Case No.328 of 2024 was recovered.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. The petitioner is in judicial custody since 17.01.2025. The stolen bike is subject matter of P.S. Case No. 328 of 2024. Moreover, there is no informant/claimant of bike.

5. Learned APP appearing for the State has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the fact that the stolen bike has been recovered from possession of the petitioner, I am not inclined to grant bail to this petitioner at this moment, however, he will be released after framing of charge by the trial court itself, with the conditions as deem fit.
