The petitioner apprehends his arrest in Maner P.S. Case No.158 of 2019 registered under Sections 147, 148, 149, 341, 448, 379, 504, 506, 323 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The informant alleged that he planted parwal in 5 bighas at Magarpal Diyara. Some persons were indulged in manufacturing country made liquor by the side of the river. Police came there and destroyed the bhatti. On 30.03.2019, some persons including the petitioner having armed with different weapons came, abused and assaulted the informant on the allegation that the informant had informed the police. The learned counsel for the petitioner submits that no specific allegation of assault is made against the petitioner.
Patna High Court CR. MISC. No.15225 of 2020(2) dt.04-09-2020 2/2 Similarly situated other accused persons namely, Bir Bahadur Rai and Rakesh Rai have been granted anticipatory bail in Cr. Misc. No.72342 of 2019 and Ashok Rai and five others have been granted anticipatory bail by order dated 03.09.2019 passed in Cr. Misc. No.55845 of 2019. The case of the petitioner stands on the same footing.
Taking into consideration the facts aforesaid that similarly situated eight accused persons out of eleven named accused persons have already been granted anticipatory bail and the case of the petitioner stands on the same footing, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Nutan Kumari, J.M. 1st Class, Danapur, District-Patna in connection with Maner P.S. Case No.158 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
