2. The petitioner seeks bail in connection with Raxaul P.S. Case No. 441 of 2024 registered for the offence punishable under Sections 8(c), 20(B), ii(C), 21(b), 22(C) and 29 of the Narcotic Drugs and Psychotropic Substances Act.
3. As per the prosecution case, 1,590 Kg of Charas and 100 gm of Brown Sugar have been recovered from outside the hut.
4. The Smack was recovered from one Raja Hussain. The name of the petitioner has come in the statement of Raja Hussain. The petitioner is in custody since 19.11.2024.
5. Considering the fact that the petitioner's name has come in the confessional statement of co-accused and nothing
Patna High Court CR. MISC. No.17856 of 2025(2) dt.16-04-2025 2/2 has been recovered from the possession of the petitioner, this application is allowed.
6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge/ Special Judge, East Champaran, Motihari/ concerned Court in connection with Raxaul P.S. Case No. 441 of 2024.
7. The petitioner will also mark attendance in Raxaul Police Station, District-East Champaran, Motihari on every Sunday of the month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
