ANJANA MISHRA ORAL ORDER 18-12-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 03.08.2017 in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 25(1/B)a, 26, 27 of the Arms Act.

Learned counsel for the petitioner submits that the present petitioner is not one of the named accused persons, but subsequently, on the confessional statement made before the police by one Jai-viru Rai who is the main accused in this case, the name of the petitioner has surfaced. Learned counsel for the petitioner further submits that, save and except the confessional statement made before the police by the co-accused, there is no further material against the petitioner. Moreover, several other similarly situated whose names have been surfaced in the confessional statement have since been extended the privilege of regular bail vide order dated 10.11.2017 passed in Cr. Misc. No. 50285 of 2017 and also in Cr. Misc. No. 58254 of 2017 vide order dated 12.12.2017.

Considering the aforementioned facts and circumstances and that the petitioner has got no criminal antecedent, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Danapur, in connection with Maner P.S. Case No. 38 of 2017.
