2. Petitioner seeks regular bail in connection with Chitragupta Nagar P. S. Case No. 27/2024 in a case registered for the offences punishable under Sections 341, 342, 324, 326, 307, 364, 302, 201, 120(B)/34 of the Indian Penal Code.
3. The prosecution story, in brief, is that on 24.05.2024, son of the informant left the house with his friends, and when he reached near Sanhauli Surya Mandir, all the F.I.R. named accused persons along with 5-6 unknown persons, including this petitioner, came by a car and surrounded the son of informant and abducted him. Patna High Court CR. MISC. No.16408 of 2025(2) dt.09-05-2025 2/3 shock with intention to kill him and threw his body behind Sitaram Memorial Inter School. Having received the information, informant's wife and family members took the victim to hospital where he was declared dead by the doctor.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner has been made accused only on suspicion. Informant is not an eye witness of the occurrence. There is no direct or indirect material against petitioner to show his involvement in the alleged crime. It is further submitted that similarly situated coaccused, namely, Karelal Yadav has already been granted anticipatory bail by this Hon'ble Court vide order dated 14.02.2025 passed in Cr. Misc. No. 69843 of 2024. Petitioner is in custody since 25.05.2024.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Khagaria in connection with Chitragupta Nagar P. S. Case No.
