JUSTICE MADHURESH PRASAD ORAL ORDER 23-07-2019 On account of allegation regarding submission of forged and manipulated educational certificates in the process of selection as Anganwari Sevika the petitioner was proceeded against.

From the order of District Programme Officer dated 30.7.2014, petitioner's Counsel submits that it is apparent that the authorities had sent the educational testimonials for verification before the concerned Board/Institute and that the

Patna High Court CWJC No.13652 of 2014(2) dt.23-07-2019 2/2 report was still not received when the District Programme Officer passed the order dated 30.7.2014 cancelling petitioner's selection as Anganwari Sevika for Center No. 97 in the district of Gopalganj.

Having regard to the aforesaid facts he submits that he would be approaching the Appellate Authority to take a decision in this respect after obtaining verification from the concerned authorities/board in respect of testimonials submitted by the petitioner.

The petitioner would be at liberty to approach the Appellate Authority within a period of four weeks. If liberty is availed and appeal filed within four weeks, without raising the issue of delay the District Magistrate (Appellate Authority ) respondent No. 5 shall proceed to consider petitioner's claim on its merit without raising the issue of delay against the appeal. The proceedings should be concluded after hearing the parties concerned and in accordance with law expeditiously and without any undue delay.

The writ application stands disposed of.
