JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

It is alleged that informant's more than Rs. ten lacs were robed. The money was recovered from the co-accused who suggested the name of the petitioner.

It is submitted by learned counsel for the petitioner that admittedly, there is no recovery from the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.26078 of 2015 (2) dt.02-07-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Purnea Sadar P.S. Case No. 321 of 2014 pending in the court of learned CJM, Purnea.

Accordingly, the application is disposed of.
