The petitioner has preferred this application for grant of regular bail in a case registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act and Sections 8, 21, 22 and 25 of the N.D.P.S. Act.
As per the prosecution case, 12 bottles of Relax cough syrup were recovered from the house of the petitioner. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in
Patna High Court CR. MISC. No.37628 of 2022(3) dt.01-08-2022 2/2 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated at para 3 of the bail petition. The said Relax cough syrup is an ayurvedic product and the detail of its chemical ingredients is not explained. The petitioner is in custody since 15.11.2021.
Learned Special A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court of Sessions Judge, Begusarai in connection with N.D.P.S. Case No. 28A of 2021 arising out of Baliya P.S. Case No. 372 of 2021.
The bail application is allowed.
