JUSTICE DINESH KUMAR SINGH ORAL ORDER 14-07-2015 At the outset, it is submitted that petitioner no. 3 above named has already been arrested, hence, this application has become infructuous so far as it relates to petitioner no. 3.
Heard learned counsels for the petitioners and the State.
The petitioner nos. 1 and 2 being parents of main accused Rakesh are apprehending arrest in a case registered for the offences punishable under Sections 498A,313,379 and 120B of the Indian Penal Code. It is claimed by the informant that she fell in love with co accused Rakesh Kumar with whom she married subsequently. After marriage she stayed in the
Patna High Court Cr.Misc. No.26084 of 2015 (3) dt.14-07-2015 2/3 house of one Paras Mahto. It is further alleged that subsequently the victim was confined in a room by these petitioners when petitioner nos. 2 took away the belongings of the informant but subsequently due to intervention of the villagers she was allowed to live in the matrimonial house. It is further alleged that in April, 2013 some medicine was administered as a result of which the pregnancy of the informant got terminated.
It is submitted by the learned counsel for the petitioners that the victim is a married lady and as per own admission she performed love marriage with co accused Rakesh and the petitioners have been roped in the present case only because they being parents of Rakesh objected to the marriage. There is nothing on record to suggest that the pregnancy of the informant was terminated.
Considering the thrust of accusation against co accused Rakesh, let the above named petitioner nos. 1 and 2 be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned JM Ist Class,
Patna High Court Cr.Misc. No.26084 of 2015 (3) dt.14-07-2015 3/3 Madhubani in connection with Khajauli P.S. Case No. 2 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
