The petitioner is in custody since 19.04.2016 in connection with Saharsa (Banmankhi) Rail P.S. Case No.24 of 2013 registered for the offence under Section302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Earlier this Court had refused the prayer for bail considering the allegation against the petitioner and others of indiscriminate firing at Matra @ Digambar Mandal causing his death. However, the court had granted liberty to the petitioner to renew his prayer for bail after nine months from the date of receipt of the order in the trial court, if the trial is not concluded within nine months.

No.58211 of 2017 (3) dt.13-12-2017 2/2 Report from the learned District & Sessions Judge, Khagaria, vide his letter dated 08.12.2017 would reveal that Sessions Trial No.250/17 is pending in his court for prosecution witnesses after framing charge on 19.07.2017. Some other accused on bail are absent in the case. Hence, trial is not proceeding. Considering the period already undergone by the petitioner as under - trial prisoner and the fact that the petitioner is not responsible for non - progress of the trial, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- with two sureties of the like amount each to the satisfaction of the District & Sessions Judge, Khagaria, in Sessions Trial No.250/17 arising out of Saharsa (Banmankhi) Rail P.S.Case No.24 of 2013 with condition that petitioner shall fully cooperate with the trial, failing which, the court below shall be at liberty to cancel his bail bond.
