JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 448, 323, 354, 324, 379 and 34 of the Indian Penal Code.

The prosecution story, in brief, is that the petitioner with bad intention entered the house of the informant and forcibly tried to establish bodily relation with her daughter-in-law during course of which he tore her blouse and saree. On her cry when the informant reached who was sitting outside, the petitioner fled away and thereafter the petitioner and other co-accused came with rod and lathi and assaulted them and Dulari Devi took away a box containing clothes, ornaments and cash amount of Rs. 9,000/-. It has been submitted on behalf of the petitioner

Patna High Court Cr.Misc. No.26956 of 2015 (2) dt.22-07-2015 2/2 that it is a case and counter case. Counter case is Annexure 2 to the present application. It is further submitted that counter case was instituted prior to the institution of the present case. The petitioner has got no criminal antecedent.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Chapra in connection with Sonepur P.S.case No. 428 of 2014, subject to the conditions as laid down u/s 438(2) Cr.P.C.
