The petitioner seeks bail in Raxaul P.S. Case No. 68 of 2018 registered for the offence punishable under Section 366A of the Indian Penal Code.
Informant is the father of the victim girl, who in his written complaint has stated that his daughter Usha Kumari aged about 17 years and 7 months has eloped from the house with an unknown person on 13.04.2018 at about 6 O' Clock with cash of Rs. 65,000/-. The victim girl has been recovered by the police and her statement under Section 164 of the Cr.P.C was recorded in which she has stated that she had gone with the petitioner with her own volition and sweet will and she was
Patna High Court Cr.Misc. No.39754 of 2018(2) dt.11-07-2018 2/2 subjected to medical examination which has determined her age to be seventeen and a half years to eighteen and a half years. Petitioner has got no criminal antecedent and is in custody since 27.04.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Raxaul, Motihari, East Champaran in connection with Raxaul P.S. Case No. 68 of 2018.
