JUSTICE VINOD KUMAR SINHA ORAL JUDGMENT Date : 12-04-2019 The appellants seek pre-arrest bail in connection with Muffasil P.S. Case No. 504 of 2018, registered for offences punishable under Sections 147, 149, 341, 342, 323, 307, 427, 353, 337, 153(A), 356 of the Indian Penal Code and Section 3(i) (r)(s), 3(2)(va) of SC/ST Act.
Allegation as per F.I.R. is that while the informant along with Sabhapati of Bihar Vidhan Sabha, SC/ST Samiti had proceeded for Khagaria from Begusarai Guest House and at around 4:10 p.m., 30-35 persons assembled there and attacked on the vehicle of the informant and damaged the same and also trying to snatch the carbine of the bodyguard of the Sabhapati. Submission of learned counsel for the appellants is that
Patna High Court CR. APP (SJ) No.1011 of 2019 dt.12-04-2019 2/2 no specific allegation has been attributed against any of the appellant and they have no criminal antecedents. Heard learned Special P.P. also, who opposed the prayer for anticipatory bail of the appellants on the ground that motorcycle of the appellants was recovered from the spot. Having heard both sides, considering the facts and circumstances of the case as stated above, let appellants, above named, be surrendered within a period of six weeks and on surrender they will release on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, S.C./S.T Act, Begusarai in connection with Muffasil P.S. Case No. 504 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
Accordingly, this appeal is allowed and the impugned order is set-aside.
