JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,324,307 and 379/34 of the Indian Penal Code. It is alleged that petitioner no. 1 stabbed the informant with knife whereas petitioner no. 2 assaulted the informant with butt of the country made pistol.
It is submitted by the learned counsel for the petitioners that the accusation appears to be false as for the occurrence of 10 A.M. on 8.5.2015 the FIR was registred on 8.5.2015 at 8.30. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that
Patna High Court Cr.Misc. No.25599 of 2015 (2) dt.01-07-2015 2/2 the injury has been found to be simple in nature. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Bhagwan Bazar P.S. Case No. 115 of 2015 pending in the court of learned CJM, Saran at Chapra. This application is disposed of with the aforesaid observation/direction.
