JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code in connection with Sarai P.S. Case No. 125 of 2014 pending before the learned Chief Judicial Magistrate, Vaishali at Hajipur. The truck, mobile and Rs.3000/- of the informant were robbed leading to registration of FIR against unknown. It is submitted by learned counsel for the petitioner that the petitioner has not bee named in the FIR, the name of the petitioner surfaced at the confession of the co-accused. Except confessional statement of the co-accused there is nothing against the petitioner and similarly situated accused persons has been granted bail vide Criminal Miscellaneous No. 10182 of 2015. The aforesaid facts constitute good ground for

Patna High Court Cr.Misc. No.25304 of 2015 (2) dt.10-07-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks.

With the above observation, this application is, accordingly, disposed off.
