The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406 and 420 of the Indian Penal Code. It is alleged that the petitioner instigated the informant to make investment of Rs. 10,000/- in a Chit Fund Company on assurance of making payment of Rs. 1600/- per month.

It is submitted by learned counsel for the petitioner that there is no proof with regard to payment made to the petitioner and the petitioner and his brother were cheated by alleged Chit Fund Company for which petitioner's side lodged Kazi Mohammadpur P.S. Case No. 291 of 2013. A statement has been made in paragraph no. 3 of the petition that the petitioner has no criminal antecedent.

Case No. 174 of 2014 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.,(West), Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
