The petitioner is in judicial custody in connection with Sessions Trial No.838 of 2021 arising out of Gopalpur P.S. Case No.243/2021 instituted under Sections 341, 323, 307, 384, 504/34 of the Indian Penal Code and section 27 of the Arms Act lodged on 19.07.2021 by the informant, Avinash Kumar. As per the allegation in the FIR, when the informant was on a walk inside his house, the accused persons including the petitioner herein armed variously came there and after demand of Rs.5,00,000/-, it is alleged that the petitioner resorted to indiscriminate firing which hit the arm of the informant, the stomach of his father and the chest of his brother. They were later taken to the Ford Hospital for treatment. The report has now been received and as per the letter

Patna High Court CR. MISC. No.17227 of 2023(3) dt.19-04-2023 2/2 no. 57 of 2023 dated 13.04.2023 out of 14 witnesses 7 have been examined while rest 7 are yet to be examined. In that view of the matter, the application stands rejected with a direction to expedite the Trial and conclude the same within a period of nine months.
