The State of Bihar .... .... Opposite Party ====================================================== CORAM: HONOURABLE MR. JUSTICE RAMESH KUMAR DATTA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioners and learned Additional P.P. for the State.

The petitioners pray for anticipatory bail in a police case under Sections 323, 324, 325, 342, 352, 307, 387 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that petitioner No.1 is a lady and petitioner Nos. 2 and 3 are her sons, both of whom are young boys and employed in private firm and have clean antecedents. It is submitted that the present matter is one of case and counter case and ultimately both the parties have compromised. It is further submitted that one person from each side were earlier arrested and both have been subsequently granted bail by the court below.

On a consideration of the facts and circumstances of the

Patna High Court Cr.Misc. No.35509 of 2014 (2) dt.20-02-2015 case, it is directed that the petitioners, namely, (1) Urmila Devi,

(2) Bittu Kumar @ Bittu Kumar Rai and (3) Ravi Kumar, in the event of their arrest/surrender in the court below within a period of four weeks from today, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Bathnaha P.S.Case No. 262/2013 to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, who shall examine the factum of compromise having been filed by the parties in both the cases, and subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
