JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 379 of the Indian Penal Code and section 27 of the Arms Act. It is alleged that on the order of Jata Singh, the petitioner caused fire arm injury on the leg of the informant. It is submitted by the learned counsel for the petitioner that in the background of land dispute and pending title suit the accusation has been levelled and for the occurrence of 20.7.2013 the FIR has been registered on 22.7.2013. It is further submitted that on conclusion of investigation, the petitioner was not sent up for trial but differing with the final form cognizance has been

Considering the fact that on conclusion of investigation the petitioner was not sent up for trial and has no criminal antecedent, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, East Champaran, Motihari in connection with Pipra Kothi P.S. Case No.138 of 2013 subject to the conditions as laid down under Section 438(2) Cr.P.C.
