The petitioner apprehends his arrest a case registered under Section 307 and other sections of the Indian Penal Code. Murari Kumar alleged that while he was passing by the side of Daha Julus (procession), the petitioner and other accused persons assaulted the informant and Lal Babu Yadav. Learned counsel for the petitioner submits that some scuffle took place as the petitioner and others were going on a motorcycle and the processionists requested them to stop the motorcycle. No specific allegation of assault is made against the petitioner. The informant got four injuries, all are simple in nature. Lal Babu Yadav did not receive any injury.
Considering the facts that the injuries are simple in nature and no specific allegation is made against the petitioner, the
Patna High Court Cr.Misc. No.33034 of 2014 (2) dt.09-02-2015 2/2 above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sitamarhi in Sursand P.S. Case No. 256/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
