Petitioner seeks bail in a case registered for the offences punishable under Sections 384, 386/34 of the Indian Penal Code, Sections 4 and 40 of the BMMC Rule, 1972, Section 8 of the Bihar Illegal Mines Transportation and Storage Prevention Act, 2003 and Section 15 of the Environment Protection Act, 1986.

Allegation is that the petitioner and other co-accused were involved in illegal mining of the sand. Petitioner is in custody since 01.12.2020.

Considering the nature of allegation and period already undergone by the petitioner, let the petitioner, above

Patna High Court CR. MISC. No.27588 of 2021(2) dt.07-10-2021 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sanhola Police Station Case No. 204 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) The petitioner shall not leave the country without permission of the learned trial court.
