Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 324, 307, 354 (B), 379, 385, 504 of the Indian Penal Code.

It is alleged that on the alleged date and time of occurrence, all the F.I.R named accused persons including these petitioners alongwith four to five unknown persons (who is family members of the informant) armed with weapons

Patna High Court CR. MISC. No.17273 of 2023(3) dt.03-07-2023 2/3 abused and assaulted the informant. As per F.I.R, Petitioner No. 1 (Jafir Akhtar) is the order giver, petitioner No. 2 (Suhail Akhtar) is alleged to have given the knife blow on the head of the informant and petitioner Nos 3 (Most. Abda Khatoon) and 4 (Anjum Ara) assaulted the informant with lathi and iron rod and they also snatched gold chain worth of Rs. 40,000/- from the possession of the informant and on protest by husband of the informant they also assaulted him and forcibly took his thumb impression on blank papers.

Petitioner No. 1 is own brother of the informant, Petitioner No. 2 is Nephew, Petitioner No. 3 is mother and the Petitioner No. 4 is Bhabhi (Sister-in-law) of the informant. It is submitted that on account of property dispute a simple occurrence of maarpeet took place between the parties. Injury caused by these petitioners have found to be simple in nature by the doctor. It is further submitted that the matter has been compromised between the parties and a joint compromise petition along with leave petition has already been filed before the court below. Petitioners claim clean antecedent.
