2. In this case, the petitioner is seeking regular bail in connection with Harsidhi P.S. Case No. 84 of 2021, registered for the offences punishable under Sections 328 and 302 of the Indian Penal Code.
3. The complainant made allegation in the complaint petition is that her son, Abhishek Dubey (deceased) who was a truck driver developed love and affection with the petitioner. He usually came to the house of the petitioner and had illicit relationship with her. As per allegation, the petitioner administered poisonous substance to the deceased and he died.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in the present case. None has seen the petitioner giving poisonous substance to the deceased. Learned counsel has submitted that brother of the deceased has sent a letter to the S.H.O., Chatauni, East Champaran dated 23.10.2020 in which he has stated that on 22.10.2020, his brother Abhishek Dubey (deceased) came to his house after purchasing vegetables and he became unconscious. He was shifted to Motihari Hospital where the Doctors apprised that he had consumed poisonous substance, subsequently, he died on 23.10.2020. The letter sent by the brother of the deceased to the S.H.O. is Annexure-3. Learned counsel for the petitioner further submitted that the petitioner is under custody since 19.11.2024.
5. On the other hand, learned APP for the State opposes the prayer for bail of the petitioner.

Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Harsidhi P.S. Case No. 84 of 2021, subject to the following
