The petitioner seeks bail in a case registered for the offence under Sections 8, 20(b)(ii)(c) of the N.D.P.S. Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 18.09.2019.

Learned A.P.P. for the State has opposed the prayer for bail and submitted that altogether 1850 grams of

Patna High Court CR. MISC. No.15268 of 2020(2) dt.04-03-2020 2/2 Marijuana/Hashish has been recovered from the conscious possession of the petitioner. The alleged quantity of recovery comes under the purview of commercial quantity. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
