The petitioner seeks regular bail in connection with Madanpur P.S. Case No. 305 of 2017 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 379, 386, 435, 504, 506 and 124-A of the Indian Penal Code and Section 17 of the C.L.A. Act.

The allegation is regarding some miscreants having torched the J.C.B. of the informant when the informant had refused to pay levy, being demanded by the miscreants. It is said that when the accused persons were communicating amongst themselves, the name of the petitioner had been taken by them and on the said basis, the name of the

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case. It is submitted that as far as the petitioner is concerned, neither he has been put on T.I. Parade nor any incriminating article has been recovered from him so as to connect the petitioner with the alleged crime. Lastly, it is submitted that the petitioner is having a clean antecedent and is languishing in custody since 04.09.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S. Case No. 305 of 2017.
