The petitioner apprehends his arrest in connection with Complaint Case No. 2259(C) of 2013 registered for the offences punishable under Section 498(A) of the Indian Penal Code. Today, the date was fixed by this court with direction to both the parties to remain present, in person, along with the child. It is with a sense of achievement that this Court is happy to note that the petitioner, namely, Karu Lal and his wife have united and they are living peacefully alongwith their son. Patna High Court Cr.Misc. No.27450 of 2015 (5) dt.09-12-2015 to live with him but the opposite party no. 2 is unhappy for the reason that the study of the son has been disturbed on account of the fact that the residence of the petitioner has been shifted to a place, which is far from the school where their son is studying. However, petitioner undertakes that he shall make all possible arrangements either to shift to a suitable accommodation which may be closer to the school or to put him in a school, which is at par with St. Karens Primary School and adjust him in an atmosphere which is conducive to his mental health and also support his education background.
In view of the present situation, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Patna in connection with Complaint Case No. 2259(C) of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
