This is an appeal under Section 14(A)(2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 against the refusal of prayer for bail by the learned Additional Sessions Judge I, Sitamarhi, in connection with Bajpatti Police Station Case No.161 of 2017, registered under Sections 302/201/120B/34 of the Indian Penal Code and Sections 3(i)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.
The appellant and his brother Sanjay Singh was suspected to have committed murder of the son of the informant. Suspicion is for the reason that Sanjay Singh had threatened to kill him for dispute relating to plucking of mango.
Patna High Court CR. APP (SJ) No.19 of 2018 (2) dt.05-02-2018 P2/ Submission is that co-accused Bhaglu Singh and Sanjay Singh have already been allowed bail by this Court in Cr. Appeal (SJ) No.3199 of 2017 vide Annexure-2.
Considering the aforesaid fact, let the appellant, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the appellant. Accordingly, the appeal stands allowed.
