The petitioner apprehends her arrest in Turkaulia P.S. case No. 447 of 2015 for the offences punishable under Section 406, 409 and 420 of the Indian Penal Code. The informant alleged that the petitioner took advance of Rs. 30,000/- for construction of her house under Indira Awash Yojna in the financial year 2011-12 but the petitioner did not complete her house till 09.04.2012. It is further alleged that petitioner has not completed her house till the date of institution of this case.
The learned counsel for the petitioner submits that the petitioner is a lady. She constructed her house but while the
Patna High Court Cr.Misc. No.40074 of 2018 (2) dt.12-07-2018 2/2 house was under construction she fell ill and, therefore, she could not complete construction work of worth Rs. 30,000/-. Now the petitioner has already completed the construction work worth Rs. 30,000/- and she filed petition for release of second installment. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is a lady, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Turkaulia P.S. case No. 447 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
