Let the defect(s), if any, be removed within four weeks.

Petitioner seeks bail in a case registered for the offence punishable under Section 30(A) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

Allegation is of recovery of liquor. Petitioner has got two identical criminal antecedent. Petitioner is in custody since 06.10.2020. Investigation of the case against the petitioner is already complete.

Considering the entire facts, let the petitioner, above named, be released, after framing of the charges so that the trial may not hamper, on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below

Patna High Court CR. MISC. No.27577 of 2021(2) dt.05-10-2021 2/2 where the case is pending in connection with Gaya Rail Police Station Case No. 79 of 2020, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of territorial jurisdiction of the learned court below.

(c) If the learned court below would notice that the petitioner is involved in other similar offence under the Bihar Prohibition and Excise Act that would be a ground for cancellation of bail in this case also.
