1. Heard learned counsel for the petitioner and the learned APP for the State.

2. Petitioner seeks regular bail in connection with S. Tr. Case No. 162/2022 arising out of Basantpur P.S. Case No. 405/2021 dated 17.09.2021 registered for the offences punishable under sections 302 and 120B/34 of the Indian Penal Code and section 27 of the Arms Act.

3. Mr. Ranjeet Kumar Pandey, learned counsel for the petitioner submits that the petitioner earlier approached this Court for the relief of regular bail by filing Cr. Misc. No. 21558/2022 which was rejected by this Court along with other criminal miscellaneous petitions filed by other co-accused persons vide order dated 13.02.2023 and thereafter co-accused Tuntun Khan @ Samir @ Babu Khan, Shahnawaz Khan and Ladla Quraishi have been granted the privilege of bail in their

Patna High Court CR. MISC. No.19005 of 2024(2) dt.20-03-2024 2/2 second attempt vide orders passed in Cr. Misc. Nos. 5273/2024, 68396/2023 and 60732/2023 and the petitioner's case stands on similar footing with the co-accused Tuntun Khan @ Samir @ Babu Khan and Shahnawaz Khan and on better footing from the co-accused Ladla Quraishi as the petitioner has got no criminal antecedent and he was not made accused in earlier criminal cases relating to the family members of the victim. Learned counsel further submits that the petitioner has been languishing in jail since 19.09.2021.

4. Mr. Ram Anurag Singh, learned APP appearing for the State has opposed the bail prayer.

5. Considering the above submissions, this Court is now inclined to accept the bail prayer of the petitioner as his case stands on similar footing with those who are on bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned in connection with S. Tr. Case No. 162/2022 arising out of Basantpur P.S. Case No. 405/2021.
