JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 05-09-2018 The Court below was directed to conclude the trial within a period of two months by order dated 24.01.2018. The trial has not concluded. There is communication made by the learned 7th Additional Session Judge cum Special Judge, Excise Act, East Champaran, Motihari, in this regard with a request for extension of time for disposal of the NDPS Case no. 43 of 2014. The request has been made on the ground that the learned Judge has assumed charge on 08.05.2018 and the records have been received by his Court on 29.05.2018.

It is stated at the Bar that all the witnesses have been examined and no further prosecution witnesses are required to be examined, which has been noted in the order dated 24.01.2018.

No.47055 of 2017(7) dt.05-09-2018 2/2 It is a matter of serious concern that despite completion of examination of witnesses way back in January 2018, the trial Court has not been able to conclude the trial despite order of this Court. The matter is pending for argument. In the facts and circumstances of the case, without entering into any probe into the reasons for delay in conclusion of the trial, I would direct the learned 7th Additional Session Judge cum Special Judge, Excise Act, East Champaran, Motihari, to conclude the arguments and deliver judgment within two months positively.
