Petitioner is seeking anticipatory bail in connection with Bodh-Gaya P.S. Case No. 546 of 2018 registered for the offences punishable under Sections 147, 148, 149, 323, 307, 379, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is no specific allegation of firing against this petitioner. It is submitted that there are general and omnibus allegation of firing against all the accused persons including this petitioner. It is further submitted that the co-accused similarly situated have been granted privilege of anticipatory bail by a learned

Patna High Court CR. MISC. No.16643 of 2019(2) dt.26-03-2019 2/2 coordinate Bench of this Court in Cr.Misc No.67541 of 2018. Learned APP for the State is present and has opposed the prayer for bail.

In the given facts and circumstances of the case wherein there is no specific allegation of firing against this petitioner, no injury report is there, petitioner has no criminal history and that the co-accused similarly situated have been granted privilege of anticipatory bail by a learned co-ordinate Bench of this Court, in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner shall be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfication of the learned C.J.M., Gaya in connection with Bodh-Gaya P.S. Case No. 546 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation.
