The petitioner apprehends her arrest in Rajgir P.S. Case No.277 of 2018 registered under Section 363A/34 of the Indian Penal Code.

The mother of the victim alleged that her daughter went to market for purchasing some articles but she did not return. The informant made search but she could not trace out her daughter. After sometimes, her daughter informed her on telephone that she was kidnapped by the accused persons and she is living in Gujarat.

The learned counsel for the petitioner submits that petitioner is mother of Pankaj Kumar. Pankaj Kumar and the daughter of the informant are having love affairs and they fled

Patna High Court CR. MISC. No.15983 of 2019(2) dt.14-03-2019 2/2 away to Gujarat. The informant went to the house of the petitioner and her husband was found inside the house. On this ground, the husband of the petitioner was granted regular bail. Petitioner is a lady.

Taking into consideration the facts that the petitioner is mother of Pankaj Kumar and petitioner was inside her house when the informant went to search her daughter who had fled away with Pankaj Kumar, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No.277 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
