JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Paraiya P.S. Case No. 77 of 2013 for the offences instituted under Sections 304(B)/34 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the petitioner and other family members tortured the daughter of the informant in various manners for non-fulfilment of demand of milky cow and motorcycle by way of dowry and ultimately killed her by putting her body on fire within three years of her marriage. It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is further submitted that the petitioner has got no criminal antecedent

Patna High Court Cr.Misc. No.26259 of 2015 (2) dt.17-07-2015 2/2 and no specific allegation has been made against this petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Paraiya P.S. Case No. 77/2013, pending in the court of the learned C.J.M., Gaya. Anyhow, if the petitioner surrenders in the court below within a period of six weeks from the date of receipt/production of copy of this order learned court below shall consider the case of the petitioner on its own merit without being prejudiced by this order.
