The petitioner seeks bail in connection with Laxmipur P.S. Case No. 115 of 2017 dated 25.06.2017 instituted for the offences under Sections 399 and 402 of the Indian Penal Code, Sections 25(1-B)a, 26 and 35 of the Arms Act as well as Sections 3/4 of the Explosive Substance Act.
The petitioner was arrested on the spot and from his possession, one loaded country made pistol and three cartridges were recovered. Many other persons were also found occupying Bolero Car, which was apprehended by the police on the suspicion of their having assembled for committing some crime. From the possession of the other accused persons also, incriminating articles were recovered.
Patna High Court Cr.Misc. No.55568 of 2017 (2) dt.30-11-2017 2/2 Learned counsel for the petitioner has submitted that two of the accused persons, who were arrested along with the petitioner, viz. Raj Kumar Sharma and Vikash Yadav have been granted bail by different Benches of this Court. The petitioner is in custody since 25.06.2017 and he does not bear any criminal antecedent.
Regard being had to the aforesaid facts, the petitioner above named is directed to be released on bail on his furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Jamui in connection with Laxmipur P.S. Case No. 115 of 2017.
