JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-05-2019 The petitioner seeks regular bail in connection with Madhepura P.S. Case No. 738 of 2017, registered for offences punishable under Sections 379 and 120B of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was rejected vide order dated 28.06.2018 passed in Cr. Misc. No. 35990 of 2018.

Prosecution case is of theft of motorcycle from the premises of Civil Court, Madhepura and later on educational certificate and Adhar Card kept in the dickey of the motorcycle was recovered from the petitioner.

It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and except on

Patna High Court CR. MISC. No.17535 of 2019(4) dt.20-05-2019 2/2 case, he is not accused in any other case. Further submission is that he has been in judicial custody 07.12.2017 and uptil now there is no substantial progress in trial, as only the case has been committed to the court of Sessions.

Having heard both sides, in view of the above facts as well as in view of the period of custody, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura, in connection with Madhepura P.S. Case No. 738 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
