Heard learned counsel for the petitioner and learned APP for the State.
The petitioner in the present case is seeking regular bail in connection with Khagaria(Muffasil) P.S. Case No.369/2017, G.R. No. 1557/2017 (S.Tr.No.248/2018) registered for the offences under Sections 341, 323, 307, 302, 34 of the Indian Penal Code. The petitioner has three criminal antecedent. He is in custody since 19.05.2018.
Learned counsel for the petitioner submits that earlier the prayer for bail of the petitioner was allowed vide order dated 10.08.2021 passed in Cr.Misc.No. 38817/2020 but he could not be released on bail because he had not disclosed his criminal antecedents in the previous bail application. It is submitted that now the petitioner has disclosed his
Patna High Court CR. MISC. No.17692 of 2022(2) dt.28-09-2022 2/2 criminal antecedents of three cases in Paragraph '3', and he is on bail in all the three cases.
Learned APP for the State has though opposed the prayer for bail of the petitioner but does not dispute the aforesaid submission.
Having regard to the facts and circumstance of the case wherein the petitioner had been earlier granted privilege of bail in Cr. Misc. No. 38817 of 2020 vide order dated 10.08.2021 but he could not be released on bail because he had not disclosed his criminal antecedents in the previous bail application but now the petitioner has disclosed his criminal antecedents of three cases in Paragraph '3', and the learned counsel submits that he is on bail in all the three cases, this Court directs release of the petitioner on bail on submission of bail bonds in terms and order dated 10.08.2021 passed in Cr. Misc. No. 38817 of 2020, subject to the conditions mentioned therein.
This writ application stands disposed of accordingly. Certified copy of the order will be made available only after removal of the defects.
