2. The petitioner is apprehending arrest in connection with Jamui P.S. Case No. 185 of 2024 lodged on 26.03.2024, for the offence punishable under Sections 147, 148, 149, 353, 332, 333, 188, 504, 341 & 323 of the Indian Penal Code read with sections 37 & 45 of the Bihar Prohibition and Excise (Amendment) Act, 2022.
3. As per the prosecution, FIR has been lodged against 15 named accused persons (including the present petitioner) and 25-30 unknown persons. It has been alleged by the informant that police received information that in a village, a fight had arisen in between the two communities accordingly, the police reached at the place of occurrence where accused persons had

No.17281 of 2025(2) dt.14-05-2025 2/3 assembled from before and they started abusing the police and even pelted stones in which police personnel were injured and on breath analyzer report, maximum people in the crowd were found in a drunken condition and the accused persons came to be identified based on video clips.
4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that there is general and omnibus allegation against the accused persons and there is no specific allegation against the petitioner. Counsel submits that the criminal antecedent of the petitioner is not clean as there is one case pending against him in which he is on bail. Counsel further submits that similarly situated accused persons have been granted bail by the Coordinate Bench of this Court vide orders dated 19.08.2024 & 24.09.2024 passed in Cr. Misc. Nos. 59167 of 2024 & 67841 of 2024 respectively.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. As such, considering the aforesaid facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of 4 weeks from today, on furnishing bail bond

No.17281 of 2025(2) dt.14-05-2025 3/3 of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Excise Court 1st, Jamui, in connection with Jamui P.S.
