The petitioner, who is in custody, seeks bail in connection with Sasaram (Model) P.S. Case No. 439 of 2017 registered for the offence punishable under Section 379 of the Indian Penal Code.

Informant has alleged in his FIR that on 08.04.2017 at about 12 'o' clock after parking his motorcycle in the court premises had gone to meet his advocate in relation to some case and when he came, he found his motorcycle missing and FIR was lodged against unknown.

It has been submitted that subsequently the motorcycle has been recovered by the police and handed over

The name of petitioner in this case has transpired on the basis of confessional statement made by one of the coaccused Avinash Yadav, except this confessional statement there is no other incriminating material against the petitioner. He is in custody since 24.02.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Model) P.S.
