====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-08-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 201 and 34 of the Indian Penal Code.
3. As per the prosecution case, police recovered a headless dead body near bank of a river which led to institution of instant FIR.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. FIR is against unknown. Petitioner's name has come in this case during course of investigation on the basis of confessional statement of co-accused Hareram Singh, who confessed that he along with this petitioner and co-accused Sunil Dubey took the dead body on the cot and proceeded towards the river. He submits that as per confessional statement, petitioner was involved in concealing the dead body. Till date, DNA test has not been conducted for conclusive identification of dead body. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer
Patna High Court CR. MISC. No.22743 of 2025(4) dt.25-08-2025 2/2 for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Simri Police Station Case No. 68 of 2024, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
