JUSTICE MADHURESH PRASAD ORAL ORDER 03-09-2019 Learned Counsel appearing for the respondent Railways raises a preliminary objection regarding maintainability of the instant proceeding since the relief in respect of recruitment process conducted by Railways at Mumbai has been challenged in the instant proceeding.

The objection as regards maintainability is raised on the twin grounds of the same being not maintainable on account of want of territorial jurisdiction as also on the ground that without approaching the Central Administrative Tribunal the petitioner has approached this Court directly under Article 226 of the Constitution of India.

None appears on behalf of the petitioners, in the circumstances without going into merits of the submissions advanced by the respondent Railway Counsel the writ petition is dismissed for want of prosecution.
