JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-07-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 21.9.2017 passed in Cr.Misc.No. 46411 of 2017 with an observation to conclude the trial within a period of nine months.

Submission of learned counsel for the petitioner is that till date not a single witness has been examined and petitioner is in custody since 27.5.2017 and he has been named on the basis of suspicion and similarly situated co-accused has been granted bail by this Court vide order dated 12.9.2017 passed in Cr.Misc.No. 42380 of 2017.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, above named, be

Patna High Court Cr.Misc. No.40750 of 2018 (2) dt.11-07-2018 2/2 released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 3rd. Additional District and Sessions Judge, Bhagalpur, in connection with Sessions Trial No. 671 of 2017, arising out of Ekchari P.S.Case No. 7 of 2017, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and petitioner has to co-operate in disposal of trial and appear before the trial court as and when required, otherwise his bail bond shall be cancelled.
