Petitioner apprehends his arrest in Tarabari P.S. Case No.138 of 2018, registered under Sections 380 and 457/34 of the Indian Penal Code.

The informant alleged that theft was committed in his Kirana shop after cutting the wall. During the course of inquiry, the informant came to know that petitioner and two others, namely, Mosabbir and Jamshed Sah were found roaming around the shop of the informant in the night.

Learned counsel for the petitioner submits that save and except suspicion, there is no material to show the involvement of the petitioner in the alleged theft in the shop of the informant. Nothing has been recovered from possession of

Taking into consideration that save and except suspicion, there appears no material against the petitioner and the fact that petitioner has got no criminal antecedent, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria in connection with Tarabari P.S. Case No.138 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Prabhat Kumar Jha, J) S.KUMAR/- U T
