JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420,406,467,468 and 120B of the Indian Penal Code.

It is alleged against the petitioner that Madhya Bihar Gramin Bank, Chainpur, Kaimur sanctioned loan amount of Rs.1,25000/- in favour of the petitioner out of which petitioner received Rs.50000/- but subsequently it was found that the petitioner took loan on the basis of forged genealogical certificate and land possession certificate.

It is submitted by the learned counsel for the petitioner that out of rupees fifty thousand Rs.25000 has already been returned to the bank and the petitioner undertakes to return the entire loan amount including up-to-date interest within two

Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three months in the event of arrest or surrender before the learned Court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 106 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C. The provisional bail will be confirmed by the learned court below if the petitioner produces certificate to the effect that the petitioner has cleared off entire loan amount including interest.
