The petitioner seeks bail in connection with Kutumba P.S. Case No. 14 of 2017 dated 12.02.2017 instituted for the offences under Sections 302, 201 and 120(B) of the Indian Penal Code.

The petitioner is the husband of the deceased. The deceased was married to the petitioner about 10 years ago and had given birth to three children.

Learned counsel for the petitioner has submitted that the relationship between the petitioner and the deceased had always been cordial and the specific indicator of the aforesaid submission is that the petitioner has a big family of three children.

Patna High Court Cr.Misc. No.52206 of 2017 (3) dt.22-12-2017 It has further been submitted that the deceased died of drowning in a well. The post-mortem report does not reveal any ante-mortem injury on the person of the deceased. The FIR also reveals that the petitioner had informed the uncle of the deceased about the deceased going missing after she had gone to attend the call of nature in the night of 09.02.2017.

The petitioner is in custody since 14.02.2017. In the facts and circumstances, the petitioner above named is directed to be released on bail on his furnishing bail bond in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S. Case No. 14 of 2017.
